Patent Filing in India

Most countries, including India, follow the First-to-File system, where patent is granted simply on the basis of priority date. Under the First-to-File system, the person who files for the patent for a given invention first is eligible for the grant of patent for that invention. Therefore, an application for a patent must be filed at the earliest possible date and should not be delayed.

Quick fact:

SIP-EIT (Support for international patent protection in electronics & information technology) is a scheme run by Ministry of Electronics & Information Technology (MeitY) to provide financial support to MSMEs and Technology Start-ups for international patent filing. The scheme provides reimbursement to a total of INR 15 Lakhs per invention or 50% of the total expenses incurred in filing and processing of patent application up to grant whichever is lesser.

While seeking patent protection in other countries it is important to know that there is no such thing as a ‘world-wide patent’. An Indian patent provides protection only within India. To obtain similar protection in other countries there can be two choices:

  • PCT application Route: Filing a single international application under the Patent Cooperation Treaty (PCT) that is administered by the World Intellectual Property Organization (WIPO).
  • Paris convention application route: Make a separate patent application in each country. This can be cost effective when you want protection in a few countries only.
